Procedures to Register Property in Bangladesh
There are seven procedures to go through before you can register your property in Bangladesh. These are:
1. First you have to go to the Land Office and verify the record of rights. They will check whether your tax records are clean or not. In Bangladesh, there are Land Record Offices which keeps land records, publication, maintenance and surveys. There are 11 sub registration offices under the Land Registration Office in Dhaka. This is monitored by the Ministry of Land.
2. Next step is, you have to conduct RS Mutation on property. This means that before the property is officially registered, RAJUK needs to enlist the property in their survey list. You need to submit the application to the Assistant Commissioner of Lands. This will be forwarded to the Tahsil Office. They will conduct a survey and give the report to the Assistant Commissioner of Lands.
3. Procedure 3 is obtaining inspections for RS Mutation. The permission is usually always granted and included both official and ‘unofficial’ payments it costs about 20,000 taka.
4. After that, the next step is obtaining the non-encumbrance certificate. It can be attained from relevant Sub-registry Office.
5. The 5th step is to prepare the legal document of transmit and paying stamp duty. It costs about 6,000 taka.
6. The next procedure is to pay capital gains tax, registration fee, VAT and other taxes at a designated bank. The registration fee is 2% of Local Government Tax. Capital Gains Tax is 2% but this is only applicable for land above 100,000 taka. 1.5% VAT is also paid in this procedure.
7. The last procedure is applying registration at the relevant Sub-registry. The change of ownership is registered in Land Revenue Office.
